CHACHI SPORTS TERMS AND CONDITIONS<\/h1>\n

Version: September 2026<\/em><\/p>\n

These terms and conditions apply to all memberships, classes, workshops, events and other services provided by Chachi Sports.<\/p>\n

By taking out a membership, booking a class or participating in a Chachi Sports activity, the member\/participant confirms that they have read and agree to these terms and conditions.<\/p>\n

Chachi Sports is based in the Netherlands and offers group classes and sports activities.<\/p>\n

1. General rules of conduct<\/h2>\n

1. Members and visitors of Chachi Sports must behave respectfully, appropriately and with good sportsmanship towards other members, instructors, staff and anyone else present.<\/p>\n

2. Members must follow the instructions of a Chachi Sports instructor, staff member or owner at all times.<\/p>\n

3. Discrimination, intimidation, aggression, threats, inappropriate behaviour, sexual harassment, bullying, vandalism and other unacceptable conduct will not be tolerated.<\/p>\n

4. Chachi Sports reserves the right to issue a warning, temporarily deny access to classes or terminate the membership of a member who fails to comply with the house rules or these terms and conditions, where the seriousness of the situation warrants this.<\/p>\n

5. In cases of serious or repeated inappropriate behaviour, Chachi Sports may decide to deny access to the studio immediately and\/or terminate the membership with immediate effect, to the extent permitted by law.<\/p>\n

2. Registration and membership<\/h2>\n

1. A membership is entered into for the period and at the rate agreed when the membership is taken out.<\/p>\n

2. A membership starts on the agreed start date and after the first payment has been made.<\/p>\n

3. Membership is personal and cannot be transferred to third parties.<\/p>\n

4. Members may not make their membership, account or class reservation available to anyone else.<\/p>\n

5. The minimum age for taking out a membership is 21, unless Chachi Sports has agreed otherwise in writing in advance.<\/p>\n

6. Members must provide Chachi Sports with accurate and up-to-date personal and contact details.<\/p>\n

7. Members are responsible for promptly reporting changes to their personal details, contact details and payment details.<\/p>\n

3. Membership plans and renewal<\/h2>\n

1. The duration, price, frequency and other terms of the chosen membership are communicated to the member when the membership is taken out.<\/p>\n

2. Memberships that can be cancelled monthly continue automatically after each payment period until the membership is validly terminated.<\/p>\n

3. A membership may only be used during the period in which it is active and all payments due have been made.<\/p>\n

4. Chachi Sports may offer different types of membership. Any terms specific to a particular membership are stated when that membership is taken out.<\/p>\n

4. Cancelling a membership<\/h2>\n

Memberships that can be cancelled monthly<\/h3>\n

1. Memberships that can be cancelled monthly, including SILVER, PEARL and GOLDEN, are subject to one month’s notice, unless a different notice period was agreed in writing when the membership was taken out.<\/p>\n

2. The notice period starts on the day Chachi Sports receives valid notice of cancellation.<\/p>\n

3. The membership ends when the applicable notice period expires.<\/p>\n

4. Notice of cancellation must be sent by email to info@chachisports.com.<\/p>\n

5. Please include the following in your cancellation:
\no full name;
\no the membership concerned;
\no the desired end date.<\/p>\n

6. Cancellation by Instagram DM, WhatsApp or solely in person is not considered formal notice unless Chachi Sports expressly confirms it in writing.<\/p>\n

DIAMOND membership<\/h3>\n

7. The DIAMOND membership is subject to the fixed term agreed when the membership is taken out.<\/p>\n

8. The membership cannot be terminated early during the fixed term, except where a statutory or contractually agreed exception applies.<\/p>\n

9. After the initial fixed term, the DIAMOND membership can be cancelled monthly, subject to the applicable notice period.<\/p>\n

10. In special circumstances, such as a long-term medical inability to participate or relocation, Chachi Sports may, upon request and acting reasonably, assess whether early termination is possible. Chachi Sports may request supporting documents.<\/p>\n

5. Payments and direct debit<\/h2>\n

1. Members must pay the membership fees due on time.<\/p>\n

2. Where direct debit has been agreed for a membership, the member authorises Chachi Sports to collect the amounts due in accordance with the agreed arrangements.<\/p>\n

3. If a direct debit cannot be collected, for example because of insufficient funds, a refused payment or a mandate withdrawn by the member, the original amount remains payable.<\/p>\n

4. Reversing a direct debit does not release the member from the obligation to pay where the amount was properly due.<\/p>\n

5. If a payment is not made on time, Chachi Sports may send a payment reminder and, to the extent permitted by law, charge reasonable costs arising from the late payment.<\/p>\n

6. If an outstanding amount remains unpaid despite reminders, Chachi Sports may refer the debt for collection. Statutory extrajudicial collection costs may be charged to the member where the statutory requirements have been met.<\/p>\n

7. If payments are overdue, Chachi Sports may suspend access to classes until the arrears have been paid, to the extent permitted by law.<\/p>\n

8. Suspending access to classes because of overdue payments does not automatically end the membership or the obligation to pay.<\/p>\n

6. Booking classes<\/h2>\n

1. Classes can only be booked through the booking system designated by Chachi Sports.<\/p>\n

2. A booking is personal and cannot be transferred to another person without permission.<\/p>\n

3. Members are responsible for booking and cancelling classes correctly.<\/p>\n

4. A booking entitles the member to attend the relevant class, provided they arrive on time and meet all participation requirements.<\/p>\n

5. Chachi Sports has a maximum capacity for each group class. The number of available places may therefore be limited.<\/p>\n

7. Cancellation and class policy<\/h2>\n

Cancelling a class<\/h3>\n

1. A booked class can be cancelled free of charge up to one hour before the class starts.<\/p>\n

2. Classes can be booked no later than one hour before the start time, provided a place is still available.<\/p>\n

3. If a member cancels a booked class less than one hour before it starts, this is considered a late cancellation.<\/p>\n

4. The first time a member cancels less than one hour before a class starts, they receive a strike.<\/p>\n

5. If the same member cancels another class less than one hour before it starts within a period of 90 days, this is considered a further strike and a penalty of \u20ac7,50 will be charged.<\/p>\n

6. Each subsequent late cancellation within the same 90-day period may result in a further penalty of \u20ac7,50.<\/p>\n

7. After 90 days without a new violation, the relevant strike expires for the purposes of this policy and the count starts again.<\/p>\n

No-show<\/h3>\n

8. If a member has booked a class but does not attend and has not cancelled the booking in time, this is considered a no-show.<\/p>\n

9. A penalty of \u20ac7,50 is charged for a no-show.<\/p>\n

10. A no-show may also be recorded as a strike under Chachi Sports’ 90-day policy.<\/p>\n

11. Failing to cancel in time or not attending a class also prevents another member from using the available place. This policy is therefore intended to allocate class places as fairly as possible.<\/p>\n

12. In exceptional situations, such as demonstrable force majeure or an acute emergency, Chachi Sports may decide to waive a strike or penalty. This is at Chachi Sports’ discretion.<\/p>\n

8. Attendance and late arrival<\/h2>\n

1. Members must arrive on time for their booked class.<\/p>\n

2. An instructor may refuse entry to a member who arrives late if participation is no longer safe or appropriate, for example if the warm-up has already started or entering would disrupt safety or the running of the class.<\/p>\n

3. If a member regularly arrives late, Chachi Sports may discuss this with them and take further measures if it continues.<\/p>\n

4. Being unable to participate because of late arrival does not automatically entitle the member to a refund, compensation or a replacement class.<\/p>\n

9. Class rules and hygiene<\/h2>\n

The following rules apply to keep classes safe, enjoyable and hygienic:<\/p>\n

1. Chewing gum is not permitted during classes for safety reasons while exercising.<\/p>\n

2. Clean trainers suitable for indoor use must be worn during class.<\/p>\n

3. Outdoor shoes may not be worn in the exercise area.<\/p>\n

4. Mobile phone use during class is not permitted unless necessary for a medical reason or another demonstrably urgent reason.<\/p>\n

5. Phones should preferably be put on silent and stored away during class.<\/p>\n

6. Photos, videos or audio recordings may only be made during class with the permission of Chachi Sports and the people featured in the recording.<\/p>\n

7. Members must wear appropriate sportswear and be considerate of other participants’ hygiene.<\/p>\n

8. Chachi Sports materials and equipment must be used carefully and only for their intended purpose.<\/p>\n

9. Any damage to Chachi Sports property caused intentionally or through culpable conduct by a member may be recovered from that member, to the extent permitted by law.<\/p>\n

10. Safety and health<\/h2>\n

1. Members participate in sports classes on their own responsibility.<\/p>\n

2. Members are responsible for assessing whether participation in a particular class is appropriate given their physical condition, health and any limitations.<\/p>\n

3. Before class, members must inform the instructor of any relevant physical limitations, injuries or other circumstances that may affect participation.<\/p>\n

4. The instructor’s directions must be followed during class.<\/p>\n

5. Members must stop an exercise immediately if it causes pain, dizziness or other physical symptoms and inform the instructor where necessary.<\/p>\n

6. Chachi Sports and its staff are not liable for damage resulting from failure to follow instructions, ignoring physical symptoms, misuse of equipment or knowingly exceeding personal physical limits, to the extent permitted by law.<\/p>\n

11. Liability<\/h2>\n

1. Chachi Sports endeavours to provide classes and activities in a safe and professional manner.<\/p>\n

2. However, participation in sports activities always carries a certain risk of injury or other physical harm.<\/p>\n

3. To the extent permitted by law, Chachi Sports is not liable for damage resulting from normal participation in sport, carelessness on the part of the member or failure to follow instructions.<\/p>\n

4. Chachi Sports is not liable for loss, theft or damage to personal belongings brought to the studio by members or visitors, unless Chachi Sports is liable under the law.<\/p>\n

5. Nothing in these terms and conditions limits any liability that cannot lawfully be excluded or limited.<\/p>\n

12. Changes to classes, instructors and the timetable<\/h2>\n

1. Chachi Sports reserves the right to change the class timetable where necessary or desirable for its business operations.<\/p>\n

2. Chachi Sports may reschedule, add, replace or cancel classes.<\/p>\n

3. Chachi Sports may replace a regular instructor with another qualified instructor.<\/p>\n

4. If an instructor is unavailable, Chachi Sports will endeavour to arrange a suitable replacement.<\/p>\n

5. If a replacement cannot be arranged, a class may be cancelled.<\/p>\n

6. If Chachi Sports cancels a class, members will be informed as soon as possible and, where applicable, the booking will be cancelled.<\/p>\n

7. Chachi Sports may cancel a workshop or event if there are insufficient participants or circumstances make this necessary.<\/p>\n

13. Photography and video recording<\/h2>\n

1. Photos and videos may be taken during Chachi Sports classes, events, workshops or other activities for communication, promotional and marketing purposes.<\/p>\n

2. Chachi Sports will handle this material carefully and take applicable privacy legislation into account.<\/p>\n

3. A member who does not wish to be recognisable in images may inform Chachi Sports before the activity.<\/p>\n

4. If separate consent is required for a specific campaign or recording, Chachi Sports will request that consent separately.<\/p>\n

14. Personal data and privacy<\/h2>\n

1. Chachi Sports processes personal data only insofar as necessary for purposes including administering memberships, payments, class bookings, communications, administration and keeping members informed.<\/p>\n

2. Chachi Sports processes personal data in accordance with applicable privacy legislation.<\/p>\n

3. For more information on the processing of personal data, please refer to the Chachi Sports privacy policy.<\/p>\n

15. Complaints and questions<\/h2>\n

1. Complaints, questions or comments about a membership, class or service can be sent to info@chachisports.com.<\/p>\n

2. Chachi Sports will assess complaints as carefully as possible and try to resolve them within a reasonable time.<\/p>\n

3. Members must first give Chachi Sports the opportunity to investigate a complaint and resolve it where possible.<\/p>\n

16. Changes to the terms and conditions<\/h2>\n

1. Chachi Sports may amend these terms and conditions where necessary, for example because of changes in legislation, services or business operations.<\/p>\n

2. Chachi Sports will notify members of changes in good time.<\/p>\n

3. Changes will not conflict with mandatory law and must not unreasonably restrict consumers’ rights.<\/p>\n

4. Where the law requires that a member be given the opportunity to terminate the agreement because of a change, Chachi Sports will provide that opportunity.<\/p>\n

5. An amended version of the terms and conditions will take effect only on the date stated in the notice of the change.<\/p>\n

17. Force majeure<\/h2>\n

1. Chachi Sports is not required to fulfil an obligation where it is temporarily or permanently prevented from doing so by circumstances that cannot reasonably be attributed to Chachi Sports.<\/p>\n

2. Force majeure may include serious technical problems, fire, government measures, illness or sudden staff unavailability, malfunctions, emergencies and other circumstances beyond Chachi Sports’ reasonable control.<\/p>\n

3. If force majeure prevents a class or activity from taking place, Chachi Sports will endeavour to minimise the consequences for members as far as possible.<\/p>\n

18. Final provisions<\/h2>\n

1. If one or more provisions of these terms and conditions prove to be invalid or unenforceable, the remaining provisions will remain fully in force.<\/p>\n

2. To the extent legally possible, an invalid or unenforceable provision will be replaced by a valid provision that reflects the purpose and intent of the original provision as closely as possible.<\/p>\n

3. The agreement between Chachi Sports and the member is governed by Dutch law.<\/p>\n

4. The parties will first try to resolve any disputes through mutual consultation.<\/p>\n

5. If a dispute cannot be resolved through mutual consultation, it will be submitted to the competent court in accordance with the applicable legal rules.<\/p>\n
